E-Discovery Defined
E-Discovery is an extension of traditional litigation
discovery practices, where opponents in a legal action must disclose
pertinent facts. Traditional discovery typically involves reviewing paper
files and other evidentiary materials. As the use of e-mails, instant
messages and electronic documents has increased, however, the rules of
discovery have been expanded to include all forms of digital data.
The term
E-Discovery refers to the process of
electronic discovery, including the collection and review of all digital data known
as Electronically Stored
Information (ESI). Although E-Discovery
typically occurs in the context of a litigation, it
can also be applied to managing ESI for other purposes such as corporate
investigations, scientific surveys and research.
